All casual users to the centre must adhere to the rules and regulations of the centre.

RELEASE

I hereby represent and warrant to Carbon Gym and its directors, officers, employees, contractors, instructors, agents and affiliates (all of the foregoing are herein collectively called “workers”) that I do not have any physical, medical or other disability or condition which may be affected or aggravated or result in any loss, damage or injury to my person or deterioration of my health if I make use in any way of or have access to or am present at or undertake any exercise, activity or evaluation at or connected with the gym, any equipment, any pool, any sauna any shower or any of the other facilities in areas available at or nearby the premises (“the premises”) located at the above address (such as gym, equipment, pools, saunas, facilities and areas hereafter being collectively called “facilities”), including, (but not limited to) participation in exercise activities outside the premises using public streets, footpaths, parks or beaches. I undertake to inform Carbon Gym in writing immediately upon my becoming aware of any such disability or condition.

I hereby irrevocably and unconditionally release Carbon Gym and each and all of its workers to the maximum extent permitted by law from any claim, actions, suits, demands, proceedings, and causes of action and any direct, indirect, resulting or consequential loss, cost expense or damage of whatsoever kind which I may incur, suffer or sustain, whether in respect of my person or property or otherwise, arising out of or in respect of connection with my use or access to or presence in or supervision, instruction, evaluation, or counselling by Carbon Gym or any of the workers in connection with the Facilities or any exercises which I do or may undertake, including (but not limited) by using the Facilities or during organised exercise outside the premises using public streets, footpaths, parks or beaches or by reason of or arising from the negligence of Carbon Gym or any of its Workers.

I hereby acknowledge and agree that while using or having access to or present in or undertaking any exercise or activity connected with the Facilities my person and property are entirely at my own risk and to the maximum extent permitted by law neither Carbon Gym or any of its Workers is liable or responsible for any direct, indirect resulting or consequential loss, cost, expenses, damage or injury to my person or property or which I may otherwise incur, sustain or suffer which is wholly or partly due to aggravated by, arises from, advice, instruction, supervision, act, omission or negligence of Carbon Gym or any of its workers or any exercise or activity which I may undertake or perform or be subjected to or do using participating or being in or at any of the Facilities or by virtue of any breach or failure to comply with any rules and Regulations of Carbon Gym.

I hereby acknowledge that the above information is accurate to the best of my knowledge. I will advise the Centre immediately of any changes in my health situation. I understand that I exercise at my own risk. With regard to the above I acknowledge that where my answers indicate that there may be a risk a risk from participating in the clubs Fitness Services, I have received advice from a medical practitioner or health professional, that indicates in their opinion, I am not at risk from participating in the proposed Fitness Service.
